Basement Apartment Legal Requirements in Utah

A basement apartment can be a great source of rental income or a home for family, but only if it is done legally. We have seen homeowners buy houses with illegal basement units and get stuck fixing them, and we have been called to bring unpermitted apartments up to code. Here is what actually makes a basement apartment legal in Utah, in plain English.

A Legal Bedroom Needs Egress

This is the single most important requirement, and the one people get wrong most. Every bedroom in a basement apartment must have a way to escape in a fire that does not depend on the interior stairs. That means either a door to the outside or an egress window: a window big enough for a person to climb out of, and for a firefighter in gear to climb in.

An egress window has minimum size requirements for the opening, a maximum sill height off the floor so someone can reach it, and if it is below grade it needs a window well large enough to open and climb out of, with a ladder if the well is deep. If a basement bedroom does not have proper egress, it is not a legal bedroom, no matter how nice it looks. Cutting a foundation wall for an egress window is real work, and it needs to be engineered and permitted.

A Separate Entrance

A true basement apartment needs its own way in and out, independent of the main house. Usually that is a private exterior door, either a walk-out at grade or a stairwell down to a below-grade entrance. Beyond being a code and function issue, a separate entrance is what makes the space livable as its own unit, so a tenant or family member is not walking through your living room to get home.

Ceiling Height and Livable Space

Habitable rooms have a minimum ceiling height under code. Older basements sometimes fall short, especially under ductwork and beams. This has to be checked before you plan a legal apartment, because you cannot just call a low space a bedroom. The living areas also need to meet minimum size and light and ventilation standards to count as habitable.

Building code is only half of it. Local zoning decides whether an accessory dwelling unit is even allowed on your lot and how it can be used. Rules vary between unincorporated Tooele County and the cities within it, and they can cover things like owner-occupancy, parking, and whether short-term rental is permitted. You Must Pull a Permit
